Condition 8503 Waived and Partner Visa Granted for Unlawful Applicant Fleeing Prior Abuse

Visa TypeSubclass 820
CategoryPartner Visa

Case Summary

An applicant from a Pacific Island nation who had overstayed her tourist visa and had a no-further-stay condition carried through past trauma obtained a waiver of condition 8503 and ultimately a Subclass 820 Partner Visa through compelling arguments based on her husband's physical dependence on her and documented prior abuse in her home country.

Background

Our client had travelled to Australia from a Pacific Island nation on a tourist visa. While in Australia, she met and married an Australian citizen. She wished to apply for a Subclass 820 Partner Visa, but faced two obstacles: she had overstayed her initial visa, and her visa carried a condition 8503 prohibiting any further visa application while she remained in Australia (other than a protection visa). Without the waiver, she could not lodge a partner visa application at all.

Challenges

  • Condition 8503 barred the applicant from lodging any further visa application without a prior waiver
  • Applicant had also overstayed her tourist visa, creating an additional Schedule 3 issue
  • Compelling and compassionate circumstances required to justify both the 8503 waiver and the partner visa
  • Sensitive evidence of prior physical and sexual abuse in the applicant's home country required careful handling

How We Helped

We first submitted a waiver application for the 8503 condition. We argued that the applicant's husband was ill and both physically and emotionally dependent on her care, and that the applicant had suffered serious physical and sexual abuse in her home country and would experience severe trauma if required to return. These arguments were accepted and the waiver was granted. We then assisted with the Subclass 820 Partner Visa application, documenting the couple's genuine relationship and co-dependency.
